1. Definitions

• "App" or "Service" refers to the SharpScan mobile application.
• "We", "Us", "Our" refers to Perfect World Studio, the developer of the App.
• "You", "User" refers to the individual accessing or using the App.
• "Content" refers to any documents, images, text, PDFs, or other materials you create, scan, upload, or process using the App.
• "Features" refers to the functionalities provided by the App, including but not limited to document scanning, OCR, PDF creation, and editing tools.

2. Acceptance of Terms

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a:

• Limited – for personal, non-commercial use only;
• Non-exclusive – the same license is granted to all users;
• Non-transferable – you may not transfer your rights to others;
• Revocable – we may terminate this license at any time for violations.

This license allows you to use the App on compatible devices that you own or control. The App is licensed, not sold, to you.

4. Eligibility

You must be at least 13 years of age (or 16 in certain jurisdictions) to use this App. If you are under the required age, you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms.

Some features of the App may require you to create an account. You agree to:

• Provide accurate and complete information during registration;
• Maintain the security and confidentiality of your login credentials;
• Immediately notify us of any unauthorized use of your account;
• Accept responsibility for all activities that occur under your account.

As a user of the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms;
• Ensure you have the legal right to scan, copy, or process any documents using the App;
• Respect the intellectual property rights of others;
• Not use the App to process, store, or distribute illegal, harmful, or offensive content;
• Verify the accuracy of OCR-extracted text before relying on it for important purposes;
• Maintain backups of your important documents.

• Illegal Activities: Using the App for any illegal purpose, including but not limited to forgery, fraud, or counterfeiting;
• Reverse Engineering: Attempting to decompile, disassemble, reverse engineer, or derive the source code of the App;
• Unauthorized Access: Attempting to gain unauthorized access to any portion of the App, its systems, or networks;
• Commercial Exploitation: Using the App or its output for commercial purposes without our prior written consent;
• Distribution: Copying, reproducing, selling, reselling, or distributing the App or any part of it;
• Circumvention: Removing, disabling, or circumventing any technological protection measures in the App;
• Harmful Content: Scanning or distributing content that is unlawful, defamatory, obscene, or violates the rights of others;
• Interference: Interfering with or disrupting the App or servers connected to the App.

9. Intellectual Property Rights

9.1 Our Rights

The App and all its components, including but not limited to software, design, graphics, user interface, logos, and trademarks, are owned by Perfect World Studio and are protected by intellectual property laws. All rights not expressly granted are reserved.

9.2 Your Rights to Your Content

You retain full ownership of all documents, images, and content that you scan, create, or process using the App. We do not claim any ownership rights over your content.

9.3 Limited License to Us

By using the App, you grant us a limited license to process your content solely for the purpose of providing the App's features. This processing occurs locally on your device, and your content is not uploaded to our servers.

10. Third-Party Services

The App integrates with the following third-party services:

• Google ML Kit: For on-device OCR and text recognition. All processing occurs locally on your device.
• Google Play Services: For app distribution, updates, and licensing.

Your use of these third-party services is subject to their respective terms and privacy policies. Please refer to our Privacy Policy for more information.

11. Disclaimers

11.1 OCR Accuracy

While we strive to provide accurate OCR results, we do not guarantee 100% accuracy. The quality of text recognition depends on various factors including document quality, lighting conditions, and language complexity. You should always verify OCR-extracted text before relying on it for important purposes.

11.2 No Warranty

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose;
• Warranties that the App will be uninterrupted, error-free, or secure;
• Warranties regarding the accuracy, reliability, or completeness of any results.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages;
• We shall not be liable for any loss of data, documents, or content;
• We shall not be liable for any damages arising from OCR inaccuracies;
• Our total liability shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Perfect World Studio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Any content you scan, create, or distribute using the App.

14. Termination

14.1 By You

You may terminate your use of the App at any time by uninstalling it from your device.

14.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms;
• Is harmful to other users or third parties;
• Is fraudulent or illegal.

14.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by:

• Posting the updated Terms with a new "Last Updated" date;
• Providing an in-app notification for significant changes;
• Updating the app description on Google Play Store.

Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to seek an informal resolution.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Vietnam.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the App.
• Severability: If any provision is found invalid, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign your rights under these Terms without our consent.
